(England) Order 2015 (As Amended) Notice Under Article 15 Town and Country Planning (Environmental Impact Assessment) Regulations 2017

Notice is hereby given that Essex County Council has received a planning application from Brice Aggregates Limited for Continuation of mineral extraction without compliance with: Conditions 4 (Approved Details); 11 (Plant Site Layout) and 55 (Restoration and Landscaping) and the Ecological Management Plan under the attendant Section 106 Agreement of Planning permission ESS/40/18/BTE that itself was a Variation of Condition permission that enabled increases in both annual throughput and HGV activity to now allow for re-phasing of the working and restoration; changes to the approved restoration concepts and management plans; and the establishment of an inert materials recycling facility, in advance of the A12 road widening infrastructure! project at Land at Colemans Farm Quarry, Little Braxted Lane, Rivenhall End, Witham, CMS 3EX - ESS/98/21/BTE. (Braintree District) (Prohibition of Waiting, Loading and Stopping) and (On-Street Parking Places) (Civil Enforcement Area) (Amendment No.17) (Part 1) Order 2021 Notice is hereby given that the Essex County Council has made the above Orders under Sections 1(1), 2(1) to (3), 3(2), 4(1), 4(2), 32(1), 35(1), 45,46,49,53 and Parts III and IV of Schedule 9 of the Road Traffic Regulation Act 1984. Effect of the orders on roads within the District of Braintree:

Notice is hereby given that the Essex County Council has made the above Orders under Sections 1(1), 2(1) to (3), 3(2), 4(1), 4(2), 32(1), 35(1), 45,46,49,53 and Parts III and IV of Schedule 9 of the Road Traffic Regulation Act 1984. Effect of the orders on roads within the District of Braintree:

1. To formalise the 'Restricted Parking Zone, No Waiting or Loading at all times, except in signed bays' on the following lengths of road:



Road Description



Manor Street From its junction with Fairfield Road, east to a point in line with the

property boundaries of numbers 33/35 Manor Street. Fairfield Road For its entire length.

Victoria Street From its junction with Fairfield Road, east to a point in line with the

property boundary of numbers 28/30 Victoria Street. Market Street From its junction with Fairfield Road, west for approximately Service Road 53.5 metres.

High Street From its junction with St Michael's Lane, south west to its junction with St Michael's Road.

St Michaels From its junction with High Street, south east for approximately Lane 29.5 metres.



2. To formalise the 'Disabled Badge Holders Only Monday - Saturday 2 Hours No Return within 3 Hours' restrictions on the south side of St Michaels Lane:



From a point approximately 30 metres south east from its junction with High Street, south east for approximately 15.5 metres.

3. To implement a 'Loading Only' Bay on the lay-by on the north side of the carriageway on Victoria Street From a point approximately 60 metres east from its junction with Fairfield Road, east for approximately 15.3 metres.



4. To implement 'Loading Only 20 minutes No Return Within 20 Minutes' restrictions on the Lay-by on the East Side of the carriageway on High Street: From a point in line with the property boundaries of 124 and 126 High Street, south west for approximately 15 metres.

5. To formalise the 'Goods Vehicles Loading Only 20 Minutes No Return Within



2 Hours' restrictions on the east side of Drury Lane: From a point approximately



3 metres south from the northern property boundary of number 4 Swan Drury Lane, south east for approximately 18 metres.

This Order will be incorporated into The Essex County Council (Braintree District) (Prohibition of Waiting, Loading and Stopping) and (On-Street Parking Places) (Civil Enforcement Area) Consolidation Order 2019 by substituting tile numbers TL755 227 and TL755 230 Revision 2 to Revision 3.

Date of operation: The Order will come into operation on 10 December 2021. Further details: If you need to view a hard copy of the order and plans please call 07703 796401 or 07515 999663 to arrange a suitable time to inspect the documents. Documents can be made available for inspection 8.30am-5.30pm Mon-Thurs and 8.30am-5pm on Friday at Essex County Council, County Hall E block main reception, Market Road, Chelmsford if so required. Alternatively, documents can be posted to you upon request.

Application to the high court Anyone who wishes to question the validity of the Order of any provision contained in it on the grounds that it is not within the powers conferred by the Road Traffic Regulation Act 1984 or on the grounds that any requirement of the Act, or any instrument made under it, has not been complied with in relation to the Order, may within six weeks from the date of the making of the Order apply to the High Court for this purpose.
