Tendring District Council Notice of Confirmation of An Order Town & Country Planning Act Section 257 Footpath 23 Great Clacton Public Path Diversion Order 2021 The above Order, confirmed on 3 June 2021 under section 257 of the Town & Country Planning Act 1990 will divert a part length of Footpath 23 in the parish of Great Clacton. Tendring District Council Planning granted application 20/00160/FUL, approved 22 June 2020, to facilitate a single storey extension to an existing storage building and to provide an extended compound at Northbourne Depot, Vista Road, Clacton On Sea Essex, which necessitates the re-routing of the footpath.

The above Order, confirmed on 3 June 2021 under section 257 of the Town & Country Planning Act 1990 will divert a part length of Footpath 23 in the parish of Great Clacton. Tendring District Council Planning granted application 20/00160/FUL, approved 22 June 2020, to facilitate a single storey extension to an existing storage building and to provide an extended compound at Northbourne Depot, Vista Road, Clacton On Sea Essex, which necessitates the re-routing of the footpath.

A part length of footpath 23 commencing from a point located north of the current boundary of Northbourne Depot running in a north westerly direction along a defined path, parallel to the current depot boundary fence for a distance of 33 metres to a point close to the north west corner of the current depot boundary running in a north, north easterly direction parallel to the railway line for a distance of 21 metres to a point at a level with the south western corner of the sports court where it continues unaffected, to an alternative route 2.4 meters in width commencing from the aforementioned start point running in first a generally northerly direction then north westerly direction across the current grass area for a distance of 49 metres to the aforementioned end point where it continues unaffected.

This Order comes into force on the date on which Essex County Council on behalf of Tendring District Council certify that the terms of Article 2 of the Order have been complied with but if a person aggrieved by the order wants to question its validity or that of any provision contained in it on the ground that it is not within the powers of the Act, or on the ground that any requirement of the Act or of any regulation made under it has not been complied with in relation to the confirmation of the Order, he or she may apply to the High Court for any of these purposes under section 287 of the Town and Country Planning Act 1990 within 6 weeks from 24 June 2021 on which notice is first published as required by paragraph 8 of Schedule 14 to that Act.
